As China expands its ecosystem for data and technology, multinationals must continuously adapt their operations, products and services. In 2021 China will tighten its data regulatory regime with the passage of the Data Security Law and the Personal Information Protection Law. What do broadening data security regulations mean for companies? And are the new regulations clearly defined?


AmCham Shanghai is pleased to present a seminar on China's evolving data security landscape. David Pan, Partner, Head of Corporate & Compliance Service Group at Llinks Law will first give a readout of the recently passed Data Security Law. Next, Carly Ramsey, Director at Control Risks will present on compliance strategies for the Data Security Law. Finally, Carly will moderate an industry panel on how companies are managing the new law, which includes Joseph Chan, Chief Legal Officer at YumChina, Boon Kim Fam, Legal Director, Compliance and Privacy, Asia Pacific at PVH Corp, and David Xu, Senior Manager, Coretech-Digital Workplace Solution at GE China.

    Partner, Head of Corporate & Compliance Service Group at Llinks

    Dr. David Pan obtained his LL.M. from Harvard Law School, and his Doctor of Jurisprudence from Shanghai Jiao Tong University. Dr. Pan was admitted to practice law in 2002. He is also admitted in New York State, USA.

    Prior to joining Llinks, Dr. Pan has practiced law in China and in the U.S. over 18 years. He accumulated an in-depth knowledge on Chinese and international business culture and legal systems. Dr. Pan has once worked in two well-known Chinese law firms, and most recently worked for a Fortune 500 Company as its General Counsel for Greater China. In addition to his corporate services such as mergers and acquisitions, joint venture, technology license etc., Dr. Pan specializes in various compliance matters including anti-trust, anti-corruption, cyber security and data protection. The clients that he represented spread over various industries, including auto, investment, energy, pharmaceutical, chemical, medical, food, advanced manufacturing, sports and entertainment, retail and consumer, real estate.

    Based on his thorough understanding on business operations, Dr. Pan also specializes in providing companies practical solution-oriented services in the regulatory compliance areas. He has advised well-known pharmaceutical, healthcare, education, professional service, tourism, advanced manufacturing, high-tech, retail and manufacture businesses in adopting, adapting and implementing antitrust and anti-corruption compliance programs in China, internal training, conducting internal investigations and dealing with external investigations, crisis management, and third party relationship management tactics.

    In the early 2000s, Dr. Pan started to represent MNCs in data and cyber security related legal matters, such as offshore server, log records storage and filing, personal data collection and use, data integrity, centralized data process, differentiation between trade secrets and state secrets etc. In the course of handling these cases, Dr. Pan gained solid practical experiences in this field.

    Carly Ramsey is based in Shanghai and leads the political and regulatory risk consulting for Greater China and North Asia. She has a decade of experience in China advising multinationals how to engage the Chinese government and mitigate political and regulatory risk.

    Prior to joining Control Risks, Carly was an Associate Director with APCO Worldwide. She led the Greater China healthcare team to provide advisory, government relations, and corporate communications strategy and execution services to major multinationals, trade associations, and governments.

    Carly’s comments on China’s political developments have appeared in major media outlets, including the Financial Times and Wall Street Journal. She has a master’s degree in foreign policy and international security from Georgetown University and a bachelor’s degree in political science from the University of Western Ontario.

    Since 2017, David Xu has been GE China's Senior Manager in Digital Workplace/IT Infrastructure, which broadly leads the IT team in Great China area and locally supports the global IT and Cyber security function teams. His first role in GE in 2015 was APAC operation leader overseeing the network and computer operation team across APAC region.

    He has 26 years of working experience in variety of IT function and roles. Before joining GE China, he lived and worked in Vancouver for about 15 years as an IT and Security Architect and senior consultant.

    He holds the Cisco CCIE designation since 1999, and CISSP as cyber security professional since 2006.
