Legal Committee Event: Mock Arbitration Tribunal (Members Only)

On Tuesday, May 16 from 11:30-14:00, AmCham Shanghai’s Legal Committee will host a Mock Arbitration Tribunal with representatives from Morrison & Foerster and the Singapore International Arbitration Centre (SIAC). Join us for an interactive event held at the AmCham Shanghai Conference Center.

The 2016 version of the SIAC rules, for the first time, contains specific rules governing the Early Dismissal of Claims and Defences. These rules hold tremendous promises for streamlining arbitration proceedings in appropriate cases, resulting in earlier determinations and significant cost savings. The mock arbitration event will explore practical applications in this innovative new procedure, and will involve a mock scenario that will highlight the potential utility of the procedure in appropriate cases. The scenario involves potentially determinative legal issues serving as the basis for an application for early dismissal of asserted defenses.

During the session, a mock arbitral tribunal will be empanelled to hear arguments by an advocate for the claimant favoring dismissal of the defenses under the new procedure, and by an advocate for the respondent opposing dismissal and in favor of proceeding to a full hearing. The role of the advocates will be played by Morrison & Foerster attorneys, while the mock arbitration tribunal will include experienced arbitration practitioners or arbitrators. A representative of SIAC will introduce the new rules and conclude with comments on the session.

Timothy Blakely
Head of Hong Kong Litigation Department at Morrison & Foerster
Timothy Blakely is head of Morrison & Foerster’s Hong Kong Litigation Department. Mr. Blakely has a broad practice focused on complex commercial litigation and arbitration matters and government and internal investigations. Mr. Blakely has represented multinational and Chinese clients in arbitration proceedings throughout the region. He also represents clients in defending, challenging, or seeking to enforce arbitral awards in related court proceedings. He is a regular speaker and writer on topics including international arbitration, compliance, and white collar crime. Mr. Blakely was named to Global Investigation Review’s inaugural “40 Under 40” list of the world’s leading investigations lawyers under the age of 40.

Craig Celniker

Craig Celniker leads Morrison Foerster’s international arbitration practice and its Asia dispute resolution practice. Dividing his time between the firm’s Hong Kong, Tokyo and Singapore offices, Craig has extensive international commercial litigation and arbitration experience with a particular emphasis on intellectual property issues. Daniel Levison is a partner in Morrison & Foerster’s Singapore office, where he represents clients in complex commercial litigation and arbitration matters across the Asia-Pacific region, where he has over 16 years of experience. Kevin Nash
Deputy Registrar & Centre Director of Singapore International Arbitration Centre (SIAC)
As Deputy Registrar & Centre Director of the Singapore International Arbitration Centre (SIAC), Kevin Nash assists with the administration of all cases filed with SIAC and the supervision of SIAC's multinational Secretariat. Since joining SIAC in 2012, Kevin has assisted with and overseen the administration of more than 1,000 international cases under all versions of the SIAC Rules and the UNCITRAL Arbitration Rules, among others, and has significant experience in SIAC cases conducted under the Expedited Procedure and applications for the appointment of an Emergency Arbitrator. He also worked closely on the revisions to the SIAC Rules 2013, the SIAC Rules 2016 and the SIAC Investment Arbitration Rules 2017.
