    Mr. Richard Yun specializes in litigation, arbitration and alternative dispute resolution as well as compliance.

    Mr. Yun frequently represents the clients in the hearings before the courts, arbitration tribunal and in alternative dispute resolution procedures. Having assisted the clients in resolving significant high stakes dispute matters pertaining to corporate, PE/VC investments, general commerce, intellectual property rights, etc., Mr. Yun also frequently advises clients on the merits assessment and development of dispute resolution strategies in alignment with their various business objectives.

    Mr. Yun, as a key member of King & Wood Mallesons’ Compliance Group, has extensive experience in the fields of compliance, corporate governance and risk management. Mr. Yun often provides compliance advice to clients on a variety matters in relation to antitrust, competition, commercial bribery and Customs. Mr. Yun also assists a number of multinational companies in drafting and enforcing compliance manuals and code of ethics and standards, dealing with external investigations initiated by the competent regulatory and enforcement agencies against those companies and conducting internal investigations.

    Areas of Practice
    Mr. Mark Fu specializes in intellectual property and is located in the firm’s Shanghai Office. His practice encompassed a variety of aspects concerning China IP law, with a primary focus on counselling multinational companies on IP related transactions, data security and privacy, IP protection and enforcement in China.

    Mr. Fu frequently undertakes due diligence and provides advisory services in support of cross-border technology transfer, licensing, merger and acquisitions, and other forms of commercial exploitation of IP assets. He has extensive experience advising multinational companies in developing strategies, policies and procedures for IP protection and anti-counterfeit projects in China, and provides guidance on implementing their protection plans from the initial investigation stage to enforcement of final judgments. In addition, Mr. Fu regularly assists domestic and overseas clients in handling patent and trademark filings, oppositions, invalidations, and other office actions and related non-contentious work in both China and the U.S.

    Mr. Fu is admitted to practice in the state of New York, and holds PRC Bar Qualification and PRC Patent Bar Qualification. He is fluent in English and is a native Mandarin speaker.

    Experience
    Mr. Fu joined King & Wood Mallesons in 2016, prior to which he worked in the Shanghai Office of a leading U.S. law firm, where he represented clients in the financial services and technology industries. Prior to that, Mr. Fu worked for a Fortune 500 U.S. company where he took charge of general IP matters for Asia Pacific.

    Mr. Fu received an LL.B. degree from East China University of Political Science and Law in 2009 before his LL.M. degree from University of Illinois College of Law. He also completed courses in Electric Engineering and Automation.

    -Represent the Commercial Aircraft Corporation of China, Ltd. in negotiation of transaction agreements with the Boeing Company in the course of establishment of Boeing 737 (Zhoushan) Completion and Delivery Center in China
    -Represent a global leading intelligent driving solutions provider in its transaction with a leading European automobile manufacturer regarding licensing and commercialization of driving assistance technology
    -Advise on a collaboration project between the China Foreign Exchange Trading Center and a financial intelligence company regarding bilateral communication of financial market data
    -Provide full service to the Hong Kong Stock Exchange regarding the bidding of transaction and closing system, the software supply license and the establishment of cyber security system for the bulk commodity transaction platform project launched by the trade center, including drafting and reviewing bidding documents, and preparing multiple IT and IP related agreements
    -Provide full local IP support to Moody’s, a US credit rating company, in his capacity as a full-time secondee.
    -Assist Bank of America, N. A., Shanghai Branch in handling its China IP/IT matters on a day-to-day basis
