AmCham Shanghai is pleased to invite you to the 2nd session of the Cybersecurity Law (CSL) Compliance Series on August 23 from 2:00 pm to 4:00pm at the AmCham Shanghai Conference Center. This session will focus on Cybersecurity Law compliance issues including critical information infrastructure (CII) and data localization requirements. It will feature a presentation by Zhang Kai (Consultant at Shanghai Information Security Association) on How Shanghai CAC Inspects CIIs, and a presentation by Richard Bell (Partner at Clyde & Co) on compliance of CII and data localization, followed by a panel discussion with industry experts on practical strategies for complying with the law.


This event is part of a CSL compliance seminar series aimed to provide members with in-depth analysis and strategies from Chinese officials, legal experts and academics on how to manage the CSL. The event is off the record.

    Kai Zhang

    Deputy Secretary-General at Shanghai Information Security Association

    Zhang Kai (张凯) is a senior engineer and the Deputy Secretary-General of the Shanghai Information Security Trade Association. With more than 10 years of experience in the IT industry, he has been involved in the construction of and consulting for more than 200 informatization projects. He has co-hosted the China Information Security Game (ISG) and the Shanghai Cybersecurity Week, which were both promoted nationwide by the Cyberspace Administration of China. In addition, with years of research experience in the cybersecurity industry, he has extensive knowledge in the establishment and management of information systems. Mr. Zhang has also joined several major information projects in Shanghai, and won the third prize of “Shanghai Science and Technology Progress.” In 2016, he helped publish the book Office Security as an associate editor.

    Richard is a dispute resolution partner in Clyde & Co's Shanghai office.

    Richard acts for clients in all areas of dispute resolution and has particular experience in joint venture disputes, property development and infrastructure disputes and disputes arising under franchise, distribution and importer agreements.

    Prior to moving to Shanghai in 2015, Richard practiced in the Middle East for 8 years; firstly with Clyde & Co in Dubai and secondly with Clyde & Co's office in Abu Dhabi where he headed up the dispute resolution team.

    Richard frequently acts for clients in cross border arbitration proceedings including LCIA, ICC, DIFC/LCIA, DIAC and ad hoc arbitrations. He also assists clients with court proceedings in overseas jurisdictions and has particular experience in dealing with disputes in difficult jurisdictions and emerging markets.

    Richard is well versed in alternative dispute resolution and is regularly instructed by clients to assist in settling claims by negotiation, mediation, expert determination and other forms of ADR.

    Richard was admitted to the New Zealand Bar as a barrister and solicitor in 1995. Prior to joining Clyde & Co in 2007, Richard worked for a well-known full service firm in Auckland, where he practiced as a general commercial litigator.

    Dr. David Pan obtained his LL.M from Harvard Law School, and his Doctor of Jurisprudence from Shanghai Jiao Tong University. Dr. Pan was admitted to practice law in 2002. He is also admitted in New York State, USA.

    Prior to joining Llinks, Dr. Pan has practiced law in China and in the U.S. over 17 years. He accumulated an in-depth knowledge on Chinese and international business culture and legal systems. Dr. Pan has once worked in two well-known Chinese law firms, and most recently worked for a Fortune 500 Company as its General Counsel for Greater China. In addition to his corporate services such as mergers and acquisitions, joint venture, technology license etc., Dr. Pan specializes in various compliance matters including cyber security and data protection. The clients that he represented spread over various industries, including energy, auto, investment, chemical, pharmaceutical, medical, food, sports and entertainment, manufacturing, real estate, retail and consumer.

    Based on his thorough understanding on business operations, Dr. Pan also specializes in providing companies practical solution-oriented services in the regulatory compliance areas. He has advised well-known pharmaceutical, retail and manufacture businesses in adopting, adapting and implementing anti-bribery and antitrust compliance programs in China, internal training, conducting internal investigations and dealing with external investigations, crisis management, and third party relationship management tactics.

    In the early 2000s, Dr. Pan started to represent MNCs in data and cyber security related legal matters, such as offshore server, log records storage and filing, personal data collection and use, data integrity, centralized data process, differentiation between trade secrets and state secrets etc. In the course of handling these cases, Dr. Pan gained solid practical experiences in this field.

    Paul EL KHOURY is the Head of Product Security for SAP Labs China, defining the product security strategy and driving its execution across the different SAP Labs locations in China. He serves as an executive advisor for the SAP’s Chief Security Officer & Head of Global SAP Labs Network on all security topics related to SAP businesses in China. In his previous roles, he was driving various security topics on the technical and organizational level for SAP globally. He holds a Ph.D. in Computer Science from the Université Claude Bernard Lyon1, with focus on security engineering. He is a Certified Information Systems Security Professional and has authored various scientific publications and patents in the field of software security.

    Mr. Lai has testified in the UK Court and worked extensively with international corporation, external legal counsel, and law enforcement agencies across UK, US, and Asia Pacific regions.

    Mr. Lai holds a Master degree in Information Security from Royal Holloway, University of London in the UK. He is an active Certified Computer Examiner (CCE) from the International Society of Forensic Computer Examiners since 2004 and also a SANS GIAC Certified Forensic Analyst (GCFA) previously.
