China's Cybersecurity Law (CSL) has ushered in a new era of tighter government regulation over the internet. Although the law has been in effect for almost a year, companies operating in China continue to face challenges in understanding and complying with the law. To provide member companies with a better understanding of the law, AmCham Shanghai is launching a new government policy seminar series on the CSL. The three-part seminar series will provide members with in-depth analysis and strategies from Chinese officials, legal experts and academics on how to manage the CSL. Seminar sessions will focus on Critical Information Infrastructure, management of personal identity information, data localization, and Cyber security strategies.


The first CSL Seminar session will focus on information management and take place on June 21 from 2:00 to 5:00 pm at the Portman Ritz Carlton Hotel. This session will feature presentations on:

  • Cross-border Data Transfer and Managing Sensitive Information by Huang Daoli (Ministry of Public Security's No. 3 Institute's Cybersecurity Law Research Center Director)
  • Commercial Products for Managing Information: Trunk Lines, VPNs, and other services by Amber Qian (China Mobile International)

    Dr. David Pan obtained his LL.M from Harvard Law School, and his Doctor of Jurisprudence from Shanghai Jiao Tong University. Dr. Pan was admitted to practice law in 2002. He is also admitted in New York State, USA.

    Prior to joining Llinks, Dr. Pan has practiced law in China and in the U.S. over 17 years. He accumulated an in-depth knowledge on Chinese and international business culture and legal systems. Dr. Pan has once worked in two well-known Chinese law firms, and most recently worked for a Fortune 500 Company as its General Counsel for Greater China. In addition to his corporate services such as mergers and acquisitions, joint venture, technology license etc., Dr. Pan specializes in various compliance matters including cyber security and data protection. The clients that he represented spread over various industries, including energy, auto, investment, chemical, pharmaceutical, medical, food, sports and entertainment, manufacturing, real estate, retail and consumer.

    Based on his thorough understanding on business operations, Dr. Pan also specializes in providing companies practical solution-oriented services in the regulatory compliance areas. He has advised well-known pharmaceutical, retail and manufacture businesses in adopting, adapting and implementing anti-bribery and antitrust compliance programs in China, internal training, conducting internal investigations and dealing with external investigations, crisis management, and third party relationship management tactics.

    In the early 2000s, Dr. Pan started to represent MNCs in data and cyber security related legal matters, such as offshore server, log records storage and filing, personal data collection and use, data integrity, centralized data process, differentiation between trade secrets and state secrets etc. In the course of handling these cases, Dr. Pan gained solid practical experiences in this field.

    He will discuss the topic “Using Personal Information for Marketing Purposes”.
