In 2002, a new PRC law allowed private investment in preschool and kindergarten through grade 12 (PK-12) education enterprises, provided they were ‘officially’ not-for-profit. Since then, more than 160,000 such private enterprises have launched, with more than 50 million students enrolled. Among these enterprises are more than 140,000 pre-schools and kindergartens, obviously the large majority of privately-invested enterprises.

During 2016, the Ministry of Education approved a revision of the law, permitting fully for-profit educational entities to operate pre-schools, kindergartens and high schools (grades 9-12 – note that grades 1 – 8 are restricted to the public education curriculum, to preserve the country’s ‘educational sovereignty’).

Effective as of 1 September 2017, the legal revision will have a powerful effect on the education sector in China. Will new educational enterprises choose to operate as fully for-profit, to increase earnings potential for investors, or as the earlier-form not-for-profit enterprises, to preserve some tax benefits? Will previously not-for-profit enterprises choose to convert? And how will foreign-invested entities’ participation in the PK – 12 sector change under the revised law?

    While with Fa Zheng Group, Mr Jia was in charge of development for Beijing Royal School branches. Co-Founder of international curriculum for Beijing No. 4 High School, and academic management of the international division of Beijing No. 2 High School, two of the best known high schools in China, with 25 years of international education development experience.

    He also served as top executives with education groups such as Ameson, EduChina and Dipont.

    Lily is a tax partner based in Deloitte Shanghai office, with over 19 years of practice in accounting, tax, legal areas in both overseas and China. She has been worked in both industries and professional firms. During year 2011 – 2012, she has been seconded to Deloitte London office.

    Lily is the founder and lead partner of Business Process Solutions (“BPS”) team. The team provides a wide range of outsourcing service to the MNC’s China operations including daily accounting, tax compliance, payroll, treasury, foreign exchange settlement and remittance, ad hoc tax and business advisory, and other statutory compliance services.

    Lily’s day-to-day work also includes assisting and advising foreign companies including foreign education institutions in starting-up their operations in China and structuring their joint venture arrangements with local Chinese partners. In addition, she regularly advised clients in contract structuring, restructuring of China operations, managing China tax compliance risk, as well as regulatory issues involving setting up operations and repatriation of funds from China.

    Lily has served many clients from different industries. From the education sector, her representative clients include Harvard University, Ningbo Nottingham University, The George Washington University, University of Leeds, University of Birmingham, The University of Glasgow, etc.. as well as many K12 international schools and private schools.

Richard has 20 years of experience in international management across industries and functions as Top Executive/ General Manager for US-headquartered corporations, many of which are in international education.
