AmCham Shanghai's Legal Committee invites you to join a session on Cyber Threats, Active Defense, and the Business and Legal Impacts on Friday, October 20 from 8:45 - 10:15 AM at the AmCham Shanghai Conference Center.

From ransomware to the Internet of Things, cybersecurity threats are escalating across the globe. China has implemented a new Cybersecurity Law and technology and the most serious hacking groups are outpacing defensive efforts. The challenge is daunting but there are steps companies can take to protect their networks, their customers, and their reputations.

Robert Silvers, partner at Paul Hastings LLP and the former Assistant Secretary of Homeland Security for Cyber Policy under the Obama administration, will address the cyber threat landscape and what the most sophisticated companies are doing to get ahead of it. Following the presentation will be a panel discussion moderated by Ningling Wang, Chair of the Legal Committee joined by panelists Robert Silvers, Haiyan Tang, partner at Paul Hastings LLP, Yang Zhou, partner at Zhong Lun, and Kevin Luo, general manager of legal affairs at Microsoft.

    Kevin LUO

    General Manager of Legal Affairs at Microsoft

    Dr. Kevin Luo is the General Manager of Legal Affairs for Microsoft Asia-Pacific R&D Group, with responsibility for all legal matters for the group. In addition, he is also overseeing cybersecurity law, regulation, and policy issues for Microsoft (China). Dr. Luo has been working with Microsoft for 18 years till today. Before joining Microsoft in 1999, Dr. Luo worked in private practice with Pennie & Edmonds LLP in New York City for 7 years. Dr. Luo holds a JD from Fordham University Law School; and a Ph.D. and M.A. from Columbia University, both in electrical engineering. Dr. Luo graduated from Tsinghua University, Beijing with a B.S. in electrical engineering. He is the Vice Chairman of the Asia Practice Committee of the Intellectual Property Owners Association (IPO).

    Robert Silvers is a partner in the White Collar Investigations and Privacy and Cybersecurity practices of Paul Hastings and is based in the firm’s Washington, D.C. office. Prior to joining the firm, Mr. Silvers served as the Obama administration’s Assistant Secretary for Cyber Policy at the U.S. Department of Homeland Security (DHS), where he was responsible for the federal government’s engagement on cyber defense with the private sector, its response during significant cyber incidents, and its pursuit of law enforcement cyber investigations. Mr. Silvers represents companies for their most critical data security and privacy challenges. He regularly navigates companies through data breach response and accompanying regulatory and litigation defense. An expert in Internet of Things security and international regulatory requirements, he also guides companies proactively to ensure compliance with privacy and security regulations and best practices.

    Haiyan Tang is a partner in the Litigation practice of Paul Hastings Shanghai office. Ms. Tang's practice focuses on government enforcement, investigations, and litigations. Ms. Tang has advised numerous companies on sensitive enforcement matters involving the U.S. Foreign Corrupt Practice Act (“FCPA”) and other corruption enforcement regimes. In addition, she acted as a leading global pharmaceutical company’s Acting Compliance Regional Director in China during a period in which the company was under a DOJ/ SEC self-reporting obligation. She previously practiced as a litigator at another top international law firm in California and litigation associate in two other international law firms in China. Ms. Tang is admitted in California only.

    Zhou Yang is a partner at Zhong Lun’s Shanghai Office. Before joining Zhong Lun, he practiced with Baker & McKenzie LLP Shanghai Office and Freshfields Bruckhaus Deringer LLP Shanghai Office respectively. Yang was also a law student observer at the Division of Corp Finnance of the SEC in D.C. in 2006. Yang is a member of the Corporate Department, specializing in cross-border M&A, TMT, cybersecurity law and data protection, Compliance/Anti-corruption. In the area of cybersecurity and data protection, Yang has advised a number of foreign and foreign-invested enterprises on the formulation or improvement of internal cybersecurity policies, improvement of data privacy policies, security assessment for cross-border data transmission, and other compliance issues under the Cybersecurity Law.
