On a quarterly earnings briefing call at the end of April, Microsoft CEO Satya Nadella said that Covid-19 accelerated 2 years of digital transformation in only 2 months. Whilst this pandemic may have brought fortunes for some, for the majority of companies this pandemic has been bad news.


One of the inevitable consequences of this bad news is that companies will undergo restructuring: of costs, programs, initiatives, a removal of all non-essential travel, a headcount freeze, a suspension of learning and development, salary cuts, and in many cases, a reduction in headcount following organisational restructuring.


In this workshop we will explore both the employee and legal angles of implementing an organisation redesign, restructuring, and redundancy program. We will equip you with a deeper understanding of the what and how of the legal aspects and strategic considerations, including case studies and practical pointers that will enable you to successfully navigate your way. Besides the legal challenges, we will provide you with the skills to enable you to approach these discussions with empathy and pragmatism.

  • What do organisations typically focus on to manage their way through a significant change (from travel to recruitment freezes; from reducing L&D spend to restructuring and reducing headcount. We will explore appropriate ways to best manage these approaches
  • Explore the creative short, medium- and long-term alternatives
  • Legal and strategic considerations of approaching restructuring in China, including the legal framework regarding reorganization, and applying learnings from case studies

  • Understanding and applying change management in a fair and equitable way
  • Communicating the decision, process, and managing the impact
  • Forewarned is Forearmed: Understanding and managing the range of personal reactions, with both the impacted individuals and the teams 'left behind' (victims and survivors)

    Partner at Simmons and Simmons

    Matthew is an experienced lawyer based in Shanghai, where he has worked lived and worked since 1999. He specializes in China employment and HR matters and is well known for advising multi-national companies in this market. He is also well versed in related China issues, such as commercial contracts, data privacy and business protection. He has extensive experience in handling the full range of employment issues faced by companies, including the people related issues arising from transactions and restructurings, as well as investigations work. His particular strength is assisting clients to navigate the specific complexities and requirements of the China legal environment within the context of their international framework and standards. He places a significant focus on developing tailored strategies and practical solutions to achieve the optimum outcome for businesses. Matthew is ranked as a “leading individual” in Legal 500 Asia Pacific and also recognized in Chambers Asia Pacific.

    Mike heads up the Talent Consulting division at Morgan Philips Group, a global talent solutions company with over 650 employees and offices in 20 countries. Mike’s principal focus is in Executive and Business Coaching – helping successful leaders achieve positive, lasting change in their behavior, both for themselves and their teams. Additionally, he provides consulting support to organizations undergoing significant change, primarily in the area of talent assessment and development.
    In a Human Resources career spanning 34 years in China, Europe and South Africa, Mike started with Unilever in South Africa where he came to appreciate the true value of diversity, and the power of recognizing potential in all, regardless of race, gender or background. Expatriated to the UK in 2000, he worked at Director level HR roles for Unilever, Müller Dairy and Tetra Pak, where his work took him across Europe, largely engaged in transformational change management, organizational redesign and restructuring. He relocated to Shanghai in 2015, with his most recent role as EVP HR for Jaguar Land Rover.
