Life as an American expat has never been more exciting – due to the dizzying speed at which the world and technology are changing, we have more options available to us. However, no matter where we go, as U.S. citizens or permanent residents, we still have U.S. tax filing obligations. Knowing the law and its implications are important, but what is even more important is having a strategy for arranging one's tax and investment affairs so as to maximize gains and minimize tax liability. In this useful seminar, we will discuss the various filing options and programs that are available to you as an American expat, major changes brought about by the Tax Cuts and Jobs Act of 2017, tax planning and strategy, and various investment structures that have tax benefits. Income and estate planning for American expats is challenging as they have to deal with the rules in their country of residence as well as the United States. This presentation will focus on the unique estate planning issues for US citizens living in China including the jurisdiction or jurisdictions that will control the disposition of assets; the use of Wills and Trusts in estate planning; estate and gift tax planning; difference between common law and civil law jurisdictions and the implications on estate planning, Trusts, and Wills; and strategies to coordinate estate planning with assets in multiple jurisdictions. There are also special estate and gift tax rules and planning considerations that will be covered when a US citizen is married to a non-US individual. The second part of the presentation will focus on individual foreign investment in the US including income, estate, and gift tax planning and traps for the unwary in transferring assets to family members in the US.
