Slipshod intellectual property protections and subsequent infringements have been longstanding grievances of foreign firms operating in China. And while this space has become more tightly regulated in recent years, understanding how to navigate China's mercurial IP space and developing a comprehensive IP protection strategy remains critical know-how for any foreign company in China.


AmCham Shanghai is pleased to present a GPS workshop on how companies can better protect their IP in China. The workshop will begin with a presentation by Shanghai Intellectual Property AdministrationDeputy Director General Zhang Yongzhong giving a rundown of the IP protection regulatory environment in Shanghai (in Chinese). Following this, Chen & Co. Law Firm Senior Consultant Dr. Xu Zhao will outline strategies for MNCs to protect their trade secrets (in English). Finally, Dr. Zhao will join Johnson & Johnson Director of Global Security – APAC Colin Chen and 3M Greater China Area IP Manager Min Gao to discuss how their companies protect IP in China (in English). This session will be off the record.


This event is an AmCham Shanghai Government Policy Support (GPS) workshop. The GPS series brings together different voices to deep-dive into Chinese government policy and its effects on American companies in China. In 2019 the program is focused across three tracks: U.S.-China Relations; Supply Chains; and R&D and Innovation.     Dr. Xu Zhao is a senior consultant at Chen & Co Law Firm and an associate professor at the Intellectual Property School of East China University of Political Science and Law. She has a Ph.D. in biotechnology from Shanghai Jiaotong University, a postdoctoral in genetics from Johns Hopkins University, a postdoctoral in intellectual property from East China University of Political Science and Law, and was a visiting scholar of Italy's University of Macerata.

    Dr. Zhao has been engaged in researching, teaching and practicing intellectual property since 2008. She has published nearly 20 articles relevant to intellectual property, hosted 4 projects at the national and provincial level, and is the author of the following books: "Essential Requirements of the Grant of Biotechnology Patents," "Translations & Comments of Classic Cases of Chemical and Pharmaceutical Patents in EPO," "Translations & Comments of Classic Cases of biotechnology Patents in EPO," "Translations & Comments of Classic Cases of biotechnology Patents in USA," and "Studies on Legal Regulation of Human embryonic stem cells." She also published an EU Madame Curie project report of Comparative studies on pharmaceutical intellectual property protection between China and Europe.

    Dr. Zhao has provided IP services for many well-known enterprises. She is also the technical expert of one major judicial authentication institution in Shanghai.

    Xiaodong Chen (Colin Chen) is the Director of Johnson & Johnson Global Security – APAC and the Vice Chair of Quality Brands Protection Committee of the China Association of Enterprises with Foreign Investment. Colin has responsibility for counterfeit, tampering and diversion product investigations and enforcement in APAC. Colin also looks for other security issues in the Johnson & Johnson Global Security – APAC region.
     
    Colin began his career with Johnson & Johnson as the Manager of the Johnson & Johnson China Intellectual Property Office on November 1, 2004.  Colin was promoted to Associate Director of the Global Security on January 1, 2009.  Colin’s team is well recognized by business leaders and Chinese authorities, industry and associations specially was highly commended by Global Anti-counterfeiting Awards in 2007.
     
    Prior to joining Johnson & Johnson, Colin worked as a police officer since 1986 at various assignments with the Ministry of Public Security in China ending at 2002 as a Deputy Director of the Division of Crime Strategy and Countermeasure of the Crime Investigation Bureau. In March 2002, Colin worked for DaimlerChrysler as a Senior Commissioner of Brand Protection with Daimler Chrysler (China) Investment Co., Ltd. 
     
    Colin has a Bachelor of Law from the People’s University of Public Security and is applying for a Law Master Degree from East China University of Politics and Law in Shanghai.

    Min Gao

    Greater China Area IP Manager at 3M

    Gao Min is 3M Greater China Area IP manager, where she heads up a team of patent counsels and trademark professionals. Before 3M, she led Adidas’ IP Team in China, working closely with its global IP team to align IP strategies, protect and enforce Adidas’ IP rights in China.

    She was also a litigator at Rouse & Co. International in Shanghai, where she represented multinational companies on enforcing their IP rights in trade secrets, trademarks and patents. Prior to joining Rouse, Min was an official at the Shanghai Intellectual Property Office, a division of the former State Intellectual Property Office (SIPO). Min is duly qualified as an attorney-at-law (2003) and a patent attorney (2004).
