2025年8月1日，最高人民法院召开新闻发布会，正式发布《最高人民法院关于审理劳动争议案件适用法律问题的解释（二）》（以下简称《解释（二）》），并介绍其指导思想和主要内容。《解释（二）》将于9月1日正式实施。

这份备受关注的司法解释，早在2023年12月12日以"征求意见稿"形式向社会公开征求意见，历经近两年打磨终于落地。随着新规施行，劳动争议的裁判标准将迎来重要变化，企业用工管理也将面临新挑战，直接影响用工成本、管理灵活性与合规风险管控。
