AmCham Shanghai's Legal Committee invites you to join a briefing on interpreting the provisions regulating cross-border data transfer on Thursday, April 11 from 9:30 a.m. - 10:45 a.m. held in the AmCham Shanghai conference room.

On March 22, 2024, The Cyberspace Administration of China (CAC) issued the official version of the Provisions on Promoting and Regulating Cross-Border Data Flows (《促进和规范数据跨境流动规定》).

To help member companies gain a better understanding of the provisions, how it will be implemented and operational implications, we have invited two legal experts Linklaters Partner Alex Roberts and Linklaters Zhao Sheng Associate Tiantian Ke to provide a detailed interpretation on the following aspects:

· Recap on PRC cross-border data transfers regime

· Key exemptions under the new provisions

· Practical considerations for different functions (e.g. can employee data exports be exempted under the HR management exemption?)

· Key implications to MNCs:

  • Ongoing China SCC or security assessment projects
  • Broader data compliance programs
