The travel and entry restrictions imposed across the world in response to the COVID-19 epidemic have caused unprecedented obstacles for global enterprises to manage their subsidiaries in China. Meanwhile, as industrial and commercial activities continue to recover in China, multinationals are facing renewed challenges how to streamline the administrative management of their businesses in China to benefit from the Foreign Investment Law and a number of implementing regulations coming into force on January 1, 2020, which are widely considered as a major step the Chinese authorities made to consolidate previously fragmented foreign investment laws.

  • Dr. Sven-Michael Werner

    Dr. Sven-Michael Werner

    Dr. Sven-Michael Werner is a partner of Bird & Bird's international Corporate Group based in Shanghai and has been living and working in China since 1999, and based in Shanghai since 2003. He has more than 20 years' experience practising law in China.

    His experience includes corporate transactions, commercial and regulatory advice, with a focus on advising clients in relation to the implementation of their technology driven, highly regulated or otherwise complex business models in China.

    During his career he has also been based in both London and Munich with a remit to develop China inbound and outbound work.

    Over the years, he has acted for businesses from all over the world helping them set up, expand, operate and close their presence in China. This work has given him profound insights into the challenges and opportunities when doing business in China. He has seen the various investment structures and vehicles commonly used, and he has a particular interest in helping clients structuring partnerships with Chinese businesses by forming joint ventures or entering into contractual arrangements such as licensing, franchising, distributing.

    Most of his projects are driven by IP or technology as a core consideration or are highly regulated. This requires careful consideration of investment structures and contractual relationships.

    Compliance and anti-bribery matters have become a strong focus for many companies in China. Sven-Michael and his team have worked with many clients on the prevention of and reaction to compliance and anti-bribery incidents.
