The U.S. Treasury Department has issued proposed regulations to implement the Comprehensive Outbound Investment National Security Act (COINS Act), which would expand the existing Outbound Investment Security Program to cover additional technology sectors, including biotechnology. Meanwhile, China's Ministry of Commerce (MOFCOM) and Ministry of Science and Technology have issued a notice soliciting public comments on proposed revisions to China's technology export control catalogue (Announcement No. 48). The proposed revisions cover 40 technologies across three sectors, including biopharmaceuticals, artificial intelligence and photovoltaics. These regulatory developments could have significant implications for cross-border investment, technology transfers, and licensing activities.
